NOTICE OF REAL ESTATE SALE
1. Judgment in the amount of $85,510.50, having been entered in favor of Plaintiff and against Defendants, which Judgment was filed with the Clerk of Courts of Cass County, North Dakota, on August 11, 2021, for the foreclosure of a real estate mortgage.
2. Notice is hereby given pursuant to said Judgment that the real property described as:
Unit Number 2012-5, Ceber Meadow Condominiums, created under a Declaration of Condominium, recorded in Book M-7 of Misc., Page 116 et seq., and Amendment thereto recorded in Book Y-7 of Misc., Page 109 and Revised Amendment thereto recorded in Book E-8 of Misc., Page 76, and Amendment of Declaration of Condominium thereto recorded in Book N-8 of Misc., on Page 479, and Amendments and Additions to Declaration thereto recorded in Book B-9 of Misc., Page 390 erected upon: All of lots Thirteen, Fourteen, Fifteen, Sixteen and Seventeen, Block Fourteen-A, in the Replat of part of Lot Sixteen, Block Six; part of Lot Nineteen, Block Twelve; Lot Two and a part of Lot One, Block Thirteen; and dedication to street of a part of Lot Twenty-six, Block Twelve, Southview Villages Addition to the City of Fargo, Cass County, North Dakota, according to the certified plat thereof, together with the undivided interest in the common elements declared appurtenant to such unit.
Real Property address: 2012 Park Boulevard South, Apt. 5, Fargo, ND 58103
The above real property is the subject of the Mortgage dated March 20, 2017, which Mortgagor, Norman R. Henschel, executed and delivered to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Quicken Loans Inc., its successors and assigns, and recorded in the office of the Clerk and Recorder of Cass County, North Dakota, on March 27, 2017, Instrument Number 1505699, which is subject to the entered Judgment. Said Mortgage was assigned to Plaintiff, its successors or assigns, by Assignment of Mortgage recorded August 27, 2019, Instrument Number 1570116.
3. In order to realize the amount of $85,510.50, as of August 11, 2021, plus interest accruing thereafter on said amount at the rate of 4.990% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction, subject to the lien for unpaid real estate taxes and assessments of Cass County, North Dakota, and easements and restrictions of record, to the highest bidder for cash under the direction of the Sheriff of Cass County, North Dakota, at the main entrance of the Cass County Courthouse located at 211 9th Street South, Fargo, North Dakota 58103, on November 24, 2021 ("Sale Date"), at 10:00 AM.
4. If the sale is set aside for reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
