NOTICE OF REAL ESTATE SALE
1. Judgment in the amount of $96,050.50, having been entered in favor of Plaintiff and against Defendants, which Judgment was filed with the Clerk of Courts of Cass County, North Dakota, on June 10, 2020, for the foreclosure of a real estate mortgage.
2. Notice is hereby given pursuant to said Judgment that the real property described as:
The South 22 feet of Lot 2 and the North 33 feet of Lot 3, in Block 26 in the Plat of the S 1/2 of Egbert, O'Neil and Haggart's Subdivision and Adjacent Ways Dedicated as recorded in Book D of Plats, Page 15, being a part of Egbert, O'Neil and Haggart's Subdivision of the NW 1/4 of Section 12, Township 139, Range 49 West of the Fifth Principal Meridian in the City of Fargo, according to the certified plat thereof on file and of record in the office of the County Recorder of Cass County, North Dakota.
Real Property address: 437 23rd St S, Fargo, ND 58103
The above real property is the subject of the Mortgage dated August 12, 2011, which Mortgagor, Betty L. Walock, executed and delivered to Wells Fargo Bank, N.A. .and recorded in the office of the Clerk and Recorder of Cass County, North Dakota, on August 18, 2011, Instrument Number 1329834, which is subject to the entered Judgment. Said Mortgage was assigned to Plaintiff, its successors or assigns, by Assignment of Mortgage recorded September 5, 2017, Instrument Number 1519779.
3. In order to realize the amount of $96,050.50, as of June 10, 2020, plus interest accruing thereafter on said amount at the rate of 2.206% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction, subject to the lien for unpaid real estate taxes and assessments of Cass County, North Dakota, and easements and restrictions of record, to the highest bidder for cash under the direction of the Sheriff of Cass County, North Dakota, at the main entrance of the Cass County Courthouse located at 211 9th Street South, Fargo, North Dakota 58103, on November 24, 2021 ("Sale Date"), at 10:00 AM.
4. If the sale is set aside for reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
