The Complaint in this action seeks a remedy of eminent domain whereby the Plaintiff, Cass County Joint Water Resource District, a North Dakota Political Subdivision, will acquire a flowage easement over, across, and through real property located in the County of Cass and the State of North Dakota, described as follows: OIN 5023 A tract of land located in the Northeast Quarter of Section Seven, in Township One Hundred Thirty-seven North of Range Forty-nine West of the Fifth Principal Meridian, situate in the County of Cass and the State of North Dakota, described as follows, to-wit: Commencing at a point which is the Southeast corner of the Northeast Quarter of Section Seven; thence North and along the East line of the Northeast Quarter for 640 feet; thence West and parallel to the South line of the Northeast Quarter for 680.6 feet; thence South and parallel to the East line of said quarter for 640 feet; thence East and along the South line of said quarter for 680.6 feet to the point of beginning.
