SECTION 00 11 13 – ADVERTISEMENT FOR CONSTRUCTION BIDS
Fargo Water Tower Nos. 4 and 7

NOTICE IS HEREBY GIVEN, that the City of Fargo, North Dakota, will receive sealed Bids at the Auditor's Office until October 9, 2019 at the hour of 11:30 a.m. local time, for the purpose of furnishing all materials, labor, equipment, and skill required for the construction of the Fargo Water Tower Nos. 4 and 7 Reconditioning, and incidental items, for said City, as is more fully described and set forth in the Plans and Specifications which are now on file in the office of the City Engineering Department. Bids will be opened in the Meadowlark Room, located on the 2nd floor at 225 4th Street North, shortly after the bid deadline and read aloud.
Bids shall be mailed or delivered to the City Auditor, City of Fargo, 225 4th Street North, Fargo, ND 58102.
The Work is comprised of a single Contract: Contract No. 1 – General Construction. The Work for is generally described as follows:
Contract No. 1: General Construction:
The Fargo Water Tower Nos. 4 and 7 Reconditioning project generally includes the following work for both Water Tower No. 4 (a 500,000 gallon capacity single pedestal water tower) and Water Tower No. 7 (a 1,000,000 gallon capacity single pedestal water tower): interior structural repairs and improvements; exterior structural repairs and improvements; surface repairs; interior paint coating removal and replacement; exterior paint coating removal and replacement; interior and exterior water tower facility containment system and hazardous waste handling and disposal requirements; the application of logos; removal of a chain link fence and installation of a vinyl fence; and miscellaneous surface restoration and seeding.
All bids shall be contained in a sealed envelope plainly marked showing that such envelope contains a Bid for the Project. Also refer to Section 00 21 13 for preparation of bid information.
All Bids shall be prepared according to the Instructions to Bidders contained within the Project Manual. Each Bid shall be accompanied by a separate envelope containing a Bid Security in the form of a Bidder’s Bond executed by the Bidder as principal and by a surety company authorized to do business in the State of North Dakota, payable to the City of Fargo, in a sum equal to five percent (5%) of the full amount of the Bid. A certified check in lieu of a surety company in the amount of 5% of the total project cost will not be accepted. This is to serve as a guarantee that the successful Bidder will enter into a Contract within fifteen (15) days of Notice of Award, in accordance with the terms of the principal’s Bid and Contractor’s Bond as required by law and regulations and determinations of City of Fargo for the performances of such Work. Only Bids that are accompanied by such a Bond will be considered.
Contracts shall be awarded on the basis of the low Bid submitted by a qualified, responsible, and responsive Bidder deemed most favorable to the City’s interest.
The City of Fargo reserves the right to reject any and all Bids, to waive any informality in any Bid, to hold all Bids for a period not to exceed forty-five (45) days from the date of opening Bids.
A pre-bid conference will be held at the Fargo City Hall, Meadowlark Room, located on the 2nd floor at 225 4th Street North, followed by a site visit to each project sites, on Thursday, September 26, 2019 at 2:00 pm, at which time the Owner’s Representatives, Bidders, and Subcontractors will discuss the project.
All Work shall be performed in accordance with the Bidding Documents on file in the Office of City of Fargo, ND where they may be seen and examined. Bidders must be licensed for the full amount of the Bid as required by North Dakota Century Code 43-07-05. Each Bid shall contain a copy of the Contractor’s license or certificate of renewal thereof issued by the Secretary of State. All Bids must be submitted on the Bid Form furnished by the Engineer. No Bid will be read or considered that does not fully comply with the above provisions and other provisions contained within the Bidding Documents, and any deficient Bid submitted will be returned to the Bidder unopened.
Contracts shall be awarded on the basis of the low Bid submitted by a responsible and responsive Bidder deemed most favorable to the Owner’s interest.
All Bids shall be contained in a sealed envelope plainly marked showing that such envelope contains a Bid for the Project. In addition, the Bidder shall place upon the exterior of such envelope the following information:
1. Project Name and Work covered by the Bidder (General).
2. The name of the Bidder.
3. Acknowledgement of all Addenda.
4. Separate envelope containing Bid Bond and a copy of Contractor’s License or Renewal Certificate.

Copies of the Bidding Documents may also be seen and examined at the office of the Engineer, Advanced Engineering and Environmental Services, Inc., 4170 28th Avenue South, Fargo, ND 58104. The Bidding Documents are available in the form of printed plans and specifications and/or PDF compact discs (CDs) from Advanced Engineering and Environmental Services, Inc. The costs are $40.00 for CDs and $200.00 for printed documents, for each set of Documents obtained. Payment for Bidding Documents is NON-REFUNDABLE. All Work shall be done according to the Bidding Documents. Bidding Documents may also be examined at the offices of AE2S in Bismarck, Grand Forks, and Williston, ND; Maple Grove, MN, and Builders’ exchanges in Grand Forks, Bismarck, Minot, Grand Forks, and Fargo, ND, in Rapid City, SD, and in Minneapolis, MN.
The work for each contract must be completed no later than the following:
Interim Substantial Completion Milestone:
The Work associated with Water Tower No. 7 shall be substantially completed (water tower shall be returned to service in the distribution system) on or before July 1, 2020. Water Tower No. 4 may not be taken out of service until Water Tower No. 7 is returned to service.
Substantial Completion: November 1, 2020
Final Completion: November 30, 2020
All Bids will be made on the basis of cash payment for such work. After Bid opening, the Owner will return Bid security of all except the three lowest responsible Bidders. When the Contract is awarded, the remaining unsuccessful Bidder's Bonds will be returned. The Owner reserves the right to reject any or all Bids, and further reserves the right to award the Contract in the best interests of the Owner. The Owner reserves the right to hold the three (3) low Bids for a period of forty-five (45) days after the date of the Bid opening to complete financial arrangements.
