NOTICE OF HEARING REGARDING REASSESSMENT OF
BENEFITS
The Southeast Cass Water Resource District (the "District") previously created, established, made assessments for, and constructed the SHEYENNE-MAPLE FLOOD CONTROL DISTRICT NO. 1 PROJECT, a diversion project in portions of Cass County, North Dakota (the "Diversion"), and confirmed an assessment list for the Diversion in accordance with North Dakota law. The District previously paid the costs of constructing the Diversion; however, the District currently levies an annual maintenance levy to pay the costs of operating and maintaining the Diversion.
The District recently reviewed the area within the Diversion assessment district (the properties protected by the Diversion) and discovered the benefits of the Diversion have changed for some properties. The District assesses annual maintenance levies based on benefits of the Diversion to each property and, therefore, the District periodically re-evaluates benefits to ensure property owners pay their fair share of maintenance and operation costs. The District's recent review of the Diversion assessment district revealed that a reassessment of benefits is necessary, fair, and equitable to more accurately reflect benefits of the Diversion to properties within the assessment district. In the course of this reassessment, the District will revise current maintenance levies according to current benefits.
In accordance with North Dakota law, the District will conduct a public hearing on the reassessment of benefits for the SHEYENNE-MAPLE FLOOD CONTROL DISTRICT NO. 1 assessment district on Monday, July 26, 2021, at 9:00 a.m. Landowners within the assessment district may appear at this hearing and offer comments or objections regarding the reassessment of benefits to the District. Following the hearing, the District will consider any input provided and will ultimately modify, correct, or confirm the maintenance levies.
The Southeast Cass Water Resource District will conduct the July 26 hearing via video conference and conference call.
