NOTICE AND ORDER FOR HEARING ON PETITION FOR CONSTRUCTION OF TRUSTS UNDER WILL AND

DETERMINATION OF BENEFICIARIES

It is Ordered and Notice is given that on February 19, 2019, at 9:00 a.m., a hearing will be held in this Court at the Cass County Courthouse, 211 S. 9th Street, Fargo, ND 58108, on a Petition filed by the trustee of the above-named trusts, Thoreson Steffes Trust Co., in the matter of the Trusts created under the Last Will and Testament of Burdick N. Richardson and Codicils and Powers of Appointment Thereto.

The Petition seeks an order of the Court: (1) determining that the definition of "descendants" provided by section 3 of Article Fifth of the Will of Burdick N. Richardson is ambiguous with regard to the intention of the testator; (2) construing and interpreting section 3 of Article Fifth of the Will, and the relevant distribution provisions of Article Fourth of the Will, to determine whether individuals adopted as adults are "descendants" under the Will; (3) releasing the trusts created under the Will and codicils and powers of appointment thereto from the continuing supervision of the Court; and (4) granting such further relief as the Court may deem just, equitable, and proper. Any objections to the petition must be filed with the Court prior to or raised at the hearing.
