WAHPETON, N.D. — A Wahpeton man accused of killing his nephew has pled not guilty to charges of negligent homicide on Monday, Jan. 13.

According to Richland County Court documents, on Nov. 29 James Bynaum and his nephew Oscar Bynaum got into a fight at a Wahpeton apartment building. The documents say during the fight, James Bynaum put Oscar into a chokehold until he went limp before leaving the apartment without checking on him.

Police say Oscar Bynaum wasn't checked on until the next day when he was found dead. A preliminary medical examiner's investigation found the manner of his death was consistent with being strangled.

A future court date for Bynaum hasn't been set yet, Richland County Attorney Casey Moen says.
