FARGO — A man charged with murder in connection to a fatal weekend shooting near North Dakota State University drew his weapon in a confrontation with the victim before shooting him, court documents allege.

Cass County prosecutors filed a Class AA felony count of murder on Tuesday, July 27, against 40-year-old Raymond Christopher Gunn. Police allege he killed 41-year-old Eric Hayes of Fargo Saturday night at Loaf 'N Jug, 1201 N. University Drive.

An incident report sheds light on the moments leading up to the shooting. Video from a security camera at the Bison Turf Bar, which is just north of the Loaf 'N Jug, shows Hayes, Gunn and another man talking with each other before Gunn pulls a firearm on Hayes, according to the incident report.

Hayes and the other man regrouped a short distance away from Gunn, but Gunn, with his weapon still in hand, then approached the two as they stood near a car, the report said.

After a short conversation, Gunn walked toward Hayes, who retreated backward, according to the report.

Hayes then "changes positions with Gunn, prompting Gunn to retreat halfway around the car, the incident report said. Gunn fell backward and shot Hayes once in the stomach, the report said.

Police responded to the shooting around 11 p.m. Saturday and found Hayes on the ground at the gas station with a gunshot wound, the report said. He died at Sanford Medical Center in Fargo.

Court documents didn't say what Gunn and Hayes were discussing before the shooting. It's still unclear what relationship they may have shared, if any.

Gunn waited at the scene and spoke with officers before being arrested on suspicion of murder. He is being held at the Cass County Jail.

He is scheduled to make his first appearance in court Wednesday afternoon. No attorney was listed to represent Gunn as of Tuesday.

The Forum reached out to Gunn through jail staff, but he declined to comment.
