STANLEY, N.D. — A 24-year-old Fargo man has pleaded guilty to murder in the death of his girlfriend's 6-month-old son in Stanley on Nov. 16.
Cody Allen Faltersack entered a guilty plea to Class AA felony murder Thursday, May 30 in Montrail County District Court. He had first been charged with Class B felony manslaughter following the baby's death. The charge was later elevated to murder in January.
Faltersack had been home alone with the baby and had been playing video games, according to court documents. When the child woke up, Faltersack allegedly bounced him "harder than he should" and dropped the baby on the left side of his head when he went to put the baby on a bed.
Faltersack told police he then changed the baby and started bouncing him again "harder than he should." The baby was whimpering and having trouble breathing and Faltersack continued bouncing him. When the baby stiffened and stopped breathing, Faltersack gave the baby breaths and chest compressions. He called an ambulance and reported that a baby was not breathing. The baby was taken to Trinity Hospital in Minot and later died of brain trauma.
Faltersack later told police he had not told the ambulance crew what really happened because he was scared. Faltersack admitted that he knew not telling the ambulance crew the real cause of the baby's injuries could have resulted in the baby sustaining further injuries during treatment.
