Man accused of deadly assault at Horace bar to change plea

FARGO — A 25-year-old man is slated to change his plea to charges that accuse him of causing the death of another this summer at a bar in Horace, N.D.

Jordan Ryker Pendleton of Horace, was scheduled to appear Thursday, Oct. 1, in Cass County District Court on several charges, including a Class B felony of manslaughter. A change of plea hearing has been set for Nov. 16, according to the North Dakota Court calendar website.

Pendleton previously pleaded not guilty to charges connected to the death of 31-year-old Marlin Klatt of Horace. Court documents allege Pendleton attacked Klatt, a bartender and another patron at Big Erv’s Bar and Grill on June 28 because he became angry with Klatt.

Pendleton hit Klatt in the face with a closed fist and knocked him unconscious, according to court documents. Klatt then fell to the ground and struck his head on the sidewalk.

The 31-year-old died later.

Pendleton also faces a Class B felony of aggravated assault and two misdemeanor simple assault charges.
