2 Fergus Falls men charged with sexual assault

One suspect told police he didn’t remember what happened in the apartment, and another suspect declined to speak to officers, a criminal complaint said.

FERGUS FALLS, Minn. — Two men face criminal charges after prosecutors said one poured alcohol down a woman's throat and then both allegedly sexually assaulted her over the weekend in Fergus Falls.

David Brent Mills, 51, and Blas Garcia, 31, both of Fergus Falls, appeared Tuesday, June 14, in Otter Tail County District Court on one count each of criminal sexual conduct. If convicted, Mills faces up to 30 years in prison, and Garcia could get 25 years.

The woman who was allegedly assaulted met a group of people at Summerfest in Fergus Falls, according to a criminal complaint. She went back to a person’s apartment, where the unnamed person had three roommates, the complaint said.

While that person was in his room, the woman was sitting on a couch in the living room when Mills grabbed her and “started pouring alcohol down her throat until it was running down her face and neck,” the complaint said.

The woman said she felt intoxicated and didn’t consent to Mills performing oral sex on her or touching her, according to court documents.

The person who was in his room came out to find Mills sexually assaulting the woman, the complaint alleged. Mills had one hand on the woman’s mouth, and Garcia had his mouth on her chest while holding her underwear, the complaint alleged.

The person who was previously in his room helped the woman leave the apartment and then called police, the complaint said. Police received the report at about 12:15 a.m. Saturday, June 11.

Garcia told police he didn’t remember what happened in the apartment, and Mills declined to speak to officers, the complaint said.

Garcia and Mills were being held at the Otter Tail County Jail. Court records did not list an attorney for either man as of Wednesday.
