The former North Dakota State University football player who was arrested at an NDSU baseball game on Tuesday night didn't know he had a warrant out for his arrest, his lawyer said on Wednesday.
Garrett Johnson, 21, is one of a dozen men accused in an alleged theft ring that police say was responsible for stealing about $150,000 in goods from Fargo's Best Buy, where two defendants worked as security guards.
Johnson was charged on April 14 with felony theft of property, the same day he was kicked off the football team, but didn't know an arrest warrant was issued for him two days later, said his attorney, Mark Friese.
"His naivety of how the system works was the reason he was arrested in a public manner," he said.
Though Johnson's arrest was too late in the day for him to appear in court on Wednesday, bail of $3,000 or 10 percent cash was set by court order. He bailed out of jail just after 3 p.m. Wednesday and is set for arraignment today in Cass County District Court.

Jeffery Ingersol, the only other Best Buy suspect yet to appear in court, is also scheduled to be arraigned today, court records show.
