Case against stabbing suspect can proceed

WILLMAR, Minn. - A psychologist has determined that a man who allegedly stabbed his stepgrandmother is not inhibited by mental illness.

Court proceedings can proceed after being suspended in September pending a mental examination of Ex-Savor Rene Cruz, 20.

Cruz is accused of  stabbing of his 64-year-old stepgrandmother, Maria Garcia, in June in Willmar.

The defense requested the mental examination, stating that Cruz may lack the capacity to understand proceedings and participate in his defense, due to a possible mental illness.

Cruz faces felony charges of second-degree attempted murder, first-degree assault - great bodily harm and second-degree assault.

According to court documents filed Nov. 20, Cruz was examined by a psychologist, who concluded that Cruz has the capacity to understand the legal proceedings.

No further court dates have yet been set.
