Costello trial on theft charge set for Feb. 3

The trial for former Clay County Sheriff Larry Costello on a charge of theft of public funds has been set for Feb. 3.

The prosecutor in the case, Assistant Dakota County (Minn.) Attorney Kathy Keena, said Friday the trial is scheduled to be held in Moorhead.

The judge presiding over the trial will be Elizabeth Hayden, who is normally chambered in Stearns County District Court in St. Cloud.

The case was referred to Keena by Clay County Attorney Lisa Borgen.

Costello was charged in Clay County District Court in April. He took medical retirement in May.

He is accused of using county funds to purchase six two-way radios late last fall that were given to friends for personal use.

Costello has denied the charge, stating that he often purchased items through the county and reimbursed the expenses from his personal checking account.
