Fargo review board declared illegal

The ruling comes in an appeal filed by a Fargo real estate developer called Mitch Malme Investments. Inspectors said they found building code violations, and Malme was ordered to pay $600 in re-inspection fees.

Malme challenged the violations and the fine. The state Supreme Court voided the fine, saying state law does not give the city of Fargo the power to set up the enforcement board.
