A preliminary hearing for Moe Maurice Gibbs involving a 2004 Fargo rape has been continued for 60 days.
The former Barnes County jailer faces a Class A felony gross sexual imposition charge for the July 2004 rape of a 22-year-old woman.
He was linked to the unsolved rape by DNA after voluntarily submitting a sample before his arrest on a murder charge in the Sept. 13 death of Mindy Morgenstern.
The hearing, originally scheduled for Wednesday, was delayed for a second time "so the state has sufficient time to provide the complete discovery of the DNA evidence," according to Cass County District Court files.
It was originally delayed from Dec. 5 to Wednesday so "the defense [could have] time to contact a DNA expert."

A new date for the prelimi-nary hearing has not been set.
Gibbs will stand trial on the murder charge in June. He also faces six sexual assault charges for assaulting five female inmates at the Barnes County Jail.
