Parties in monument lawsuit seek decision

Both parties in a federal lawsuit over the placement of a Ten Commandments monument on the plaza of Fargo City Hall have asked a judge to decide the case.

In a motion for summary judgment, Fargo city officials say the city hasn't used taxpayer money to erect or maintain the monument.

Also, the monument doesn't interfere with its opponents' use of the mall grounds, the motion says.

In 2002, five Fargo men filed a lawsuit in Fargo's federal court seeking to get the monument removed.

The men, Wesley Twombly, Davis Cope, Jon Lindgren, Lewis Lubka and William Treumann, filed their own motion for summary judgment May 14.

In their motion, the men say the monument violates the Constitutional separation of church and state.
