The owner of a Moorhead gym that closed in 2008 will serve five years of probation for continuing to do business after his sales tax permit was revoked.
Kurt Ross, 46, of Fargo, had been charged with five tax-related felonies, but all were dismissed except for the sales-tax count in exchange for the guilty plea.
According to the Minnesota Department of Revenue, Ross failed to file state income tax returns from 2003 to 2005 for the Moorhead Racquetball and Fitness Club and had his sales and use tax permit revoked as a result.
The fitness club closed in August 2008 after it was evicted from its building at 3501 8th St. S., which was owned by Concordia College. He allegedly owed 10 months of unpaid rent that totaled $27,000.
As a condition of probation, Ross is required to file tax returns. Clay County District Court Judge Steven Cahill granted Ross a stay of imposition, which means the conviction will come off his public record if he completes probation.
