Alfonso Rodriguez Jr. will be formally sentenced to death at a 9 a.m. hearing Feb. 8, according to paperwork filed Friday.
The court rescheduled the hearing after U.S. District Judge Ralph Erickson underwent emergency surgery for a ruptured appendix late last month. A doctor ordered no work for Erickson until at least this week.
A jury returned a death verdict Sept. 22 for Rodriguez, convicted in the kidnapping and murder of Dru Sjodin.
Erickson planned to hear arguments Jan. 5 about whether Rodriguez deserves a new trial. The hearing was pushed back to Jan. 26, the date Erickson had originally planned to formally impose the jury's verdict.
